Media Retention Policy


1. Introduction

This Media Retention Policy applies to all video, audio, graphics and other media assets (“Media”) collected by HOURGLASS HOLDINGS PTY LTD (“we” or “us”) during the production of video projects for our clients. This Policy details how we store, retain and dispose of your Media, as well as your rights regarding its access and ownership.

2. Media Collection and Ownership

Project-based: As part of our video production services, we capture footage and audio recordings, and create project files that constitute your final video deliverables. Perpetual use rights of the final edited video product transfers to you upon delivery and payment, as outlined in our Services Agreement.

Unedited Material: We may also retain unedited raw footage, outtakes and temporary files necessary for project completion and potential revisions.

Third-party sources: In some cases, we may incorporate media from third-party sources like stock footage and audio libraries with specific licensing agreements. These licences determine ownership and usage rights beyond this Policy.

3. Transfer of ownership and usage rights

Clients have the option to purchase unedited raw footage captured during production at an additional fee. Purchased raw footage will be delivered in a designated format upon full payment.

Clients are granted a non-exclusive, non-transferable licence to use the purchased raw footage for commercial purposes within the bounds of this policy.

4. Prohibited Uses

Client shall not modify, adapt, or use the purchased raw footage in any way that;

  • Defames, disparages, or harms the reputation of REDfusion Studios or its personnel.
  • Violates applicable laws or regulations.
  • Portrays REDfusion Studios or its personnel in a false or misleading light.
  • Includes footage of REDfusion Studios’ team members asking questions (including during interviews) or footage of REDfusion Studios’ personnel without their express written consent.
  • Redistribution: Client may not sell, lease, loan, or otherwise redistribute the purchased raw footage to any third party without REDfusion Studios’ prior written consent.

5. Media Retention and Disposal

Default Retention Period: All Media not explicitly requested for retention will be securely deleted or destroyed 18 months after the completion of your project. This allows us to address potential post-production requests and ensures efficient data storage management.

Client-Initiated Retention: You have several options to retain your Media beyond the default period:

  1. Raw Footage Purchase: You can request the purchase of your raw footage for individual projects or complete footage archives. We will process the purchased footage and either provide you a download link or send you a physical drive upon full payment.
  2. Processed RAW Footage: You can request the purchase of complete footage reels, filtered to remove unusable footage and anomalies. We will archive footage reels securely and make it accessible upon full payment.
  3. Media Archive Subscription: You can subscribe to our secure media archive service. For an annual fee, we will retain unedited Media and project files, keeping media library options available for REDfusion Studios editing throughout your subscription period.
  4. Custom Retention Agreement: In special cases, you may discuss custom retention arrangements with us for specific media assets (e.g. sentimental footage).

6. Client Indemnification

Client agrees to indemnify and hold harmless REDfusion Studios against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to Client’s use of the purchased raw footage in violation of this Policy or applicable laws.

7. Data Security and Access

All Media is stored on secure servers with industry-standard data protection measures. We restrict access to authorised personnel for post-production and administrative purposes only. We will not share or disclose your Media to any third party without your express consent, except under legal requirements or as permitted by relevant licensing agreements for incorporated third-party media.

8. Termination and Data Disposal

Upon termination of our services due to contract completion, non-renewal, or any other reason, your Media will be subject to the default retention period. Please ensure to request the purchase of raw footage or subscribe to our media archive service before the expiry of the applicable timeframe.

9. Policy Updates

We reserve the right to update this Media Data Retention Policy as needed. We will notify you of any changes by posting the updated Policy on our website or contacting you directly.
